The ICN Unilateral Conduct Working Group was established in May 2006, at the Fifth Annual ICN Conference. Its primary objectives are to examine the challenges involved in addressing anticompetitive unilateral conduct of dominant firms and firms with market power, and to promote greater convergence and sound enforcement of laws governing unilateral conduct. The Working Group benefits from the participation of representatives from thirty-seven ICN member agencies, the Organization of Economic Cooperation and Development (OECD) and non-governmental advisors from around the globe. The Working Group consists of two subgroups – the Objectives subgroup, which is examining the goals of competition laws on unilateral conduct, and the Assessment of Dominance/Market Power subgroup, which is examining the definition and assessment of dominance/market power. The subgroups also will address unilateral conduct issues related to state-created monopolies and recently-privatized firms as part of their work. The Working Group’s 2006-2007 Work Plan provides further details on the initial projects to be undertaken. As identified in the Working Group’s Mandate, the Working Group will examine potentially abusive conduct as part of the second phase of its work.
